Here the attorneys for Florida display all the grand consideration for justice one now gets from our “public servants.” Claiming that the 2nd Circuit decision didn’t “expressly” say all the points which, nevertheless, resulted in Paey’s continued incarceration, the lawyers here seek to sidestep the central issue: was Paey dealt with in a manner that respected his constitutional rights?


As usual, these “public servants” unabashedly view their role as protecting the power structure of the police apparatus, headed by the executive against all claims of overreach, no matter how compelling. The Florida constitution and the US constitution create a system of checks and balances. These attorneys were sworn to uphold those constitutions. That important point seems to have been lost in the desire to prevail at all costs.
